With the further development of the reform and open policy and the market economy, to accelerate the pace of China’s urbanization, population mobility between cities and between urban and rural areas is more and more frequently, transfer of population and urban quality of life and economic high speed development to induce a number of surplus rural labor to urban transfer and economically underdeveloped regions to economically developed areas and by individual migration gradually transformed for family flow, resulting in a special group, migrant children rights protection has since been put on the agenda. Migrant children’s right to education and education fair has been a hot issue in the academic discussion on this issue, countries also continue to develop new policies and legal system in order to solve the migrant children’s education issues.Children of migrant population due to liquidity, weak learning foundation, psychological vulnerability, their education of status can be divided as the following: part because all sorts of reasons can not enter the gate of the school to enjoy school education; part can enjoy school education regularly, but can not enjoy equal education conditions; part used to enjoy school education but halfway drop out, unable to continue education. As a significant contributor to the development of urban economy, the migrant population can not enjoy the urban resources equally, although the right to education is the basic rights prescribed by the constitution of China citizens, however, when they firmly believe that knowledge to change the fate of all their hopes in the next generation, but because of various factors, their children can not enjoy the urban education.This is no doubt a malicious trample on their rights, and is not conducive to the long-term stability of the country, but also contrary to the scientific concept of people-oriented.As a special group of our country, the migrant children’s educational situation is not satisfactory compared with the children in the city,for example,admission and further education opportunities are not equal,a lot of inflow cities is setting many conditions to limit outsiders’ children to learn and further education;The quality of teaching in schools is different,education resources distribution is not unbalanced,there are many private schools specializing in the reception of the children lack of teachers and educational facilities;Even if the children are able to enter the school,but due to the cultural differences,understanding level and other factors,education integration is difficult,they may will have a sense of inferiority, even drop out of school.There are many reasons migrant children can not enjoy the equal right to education, the existing legislation is not perfect, but also have the household registration and education finance policy constraints,and the relief system is also lack,at present,the migrant children rights protection law does not formed an integral system,and the imperfect education appeal system makes the children’s education rights violated when they can not get relief,in addition, China’s urban and rural, between cities and cities,even between the different areas of the same city exist long-standing education resources distribution imbalance phenomenon,which also bring migrant workers of children’s education great difficulties.This article will explain the connotation and nature of the right to education of migrant workers’ children,and review and analyz the reasons that the children cannot enjoy the equal right to education. And on this basis, respectively, from the household registration system, education funding, legal system and other aspects are discussed, the aim is to find a solution to the problem of migrant children’s right to education, and strive to achieve the "learning, good learning" and promote the harmonious development of society.
