The Research Of The Perfection Of Anti-terrorism Legislation

The terrorism issue had a long history. In ancient times, the politicians were the main victims, and in fact, these issues were not real terrorist incident. As time went on and the global society kept developing, the terrorism showed up after the world war II. The terrorists made explosion、hijacking、kidnapping in some settlement and countries. After the 70 decade of last century, terrorism has gradually spread to the entire international community, and the terrorist incidents increased year by year. The terrorist organizations grows bigger and bigger. Especially after the "9.11", terrorism has become a threat to the international community. Every country put their attention on it, and enacted some legal measures to prevention and combat. The last two years, the terrorist attacks appeared in China.In the past year, terrorist incidents happen in China frequently. It is been an important focus to researching the legal measures to against the terrorism.The anti-terrorism legislation has became imminently. In march 2015, the Standing Committee of the National People’s Congress deliberated the Anti-terrorism law in the second time. It’s improved some measures such as determine the terrorist organization and the members、anti-terrorism security、coping with terrorism events, and so on. The author of this paper will consider the current situation, and try to research the perfection of Anti-terrorism legislation. May the work can enrich the study of anti-terrorism of law theory, and make a contribution to maintain social order and country’s stability.This paper is divided into three parts. The first part summarizes the different interpretation of terrorism between China and the West. Pointing out there dose not exist an unitary definition to terrorism in international community.Concluding the characteristics of terrorist activity. Illustrating the cause and the development of terrorism. And then, point out the major terrorism threat which China is facing. The second part, summarizing China’s anti-terrorism legislation frame and the draft of the Anti-terrorism Law firstly, then analyzing the problems of anti terrorism legislation in China from several aspects. Pointing out that the current legislation model has not enough to cope with the growing situation of terrorism, so China needs enact an special completely law. In the end, the author combining with the anti-terrorism law draft, trying to make some suggestions.
