n recent years, because of the frequent occurrence of environmental pollution, ecological damage and other environmental hazards, not only hinder the further development of social economy, but also directly infringe the legitimate rights and interests of the public, so that the public to strengthen the environmental protection, the establishment of public interest litigation, the establishment of public interest litigation system is increasingly high. In January 1,2013, the formal implementation of new civil procedure law clearly gives the agency and the social organization of public interest litigation, but because of the social organization of public interest litigation has many limitations and its own shortcomings, leading to many difficulties in the public interest litigation, is not conducive to the timely and effective protection of public interest, therefore, in order to protect the public interest, the public interest litigation right is particularly necessary. Throughout the foreign procuratorial system, giving the procuratorial organ the right to bring the public interest litigation, in order to safeguard national interests and social public interests, is the practice of most countries in the world. In this paper, the author summarizes the exploration and practice experience of the procuratorial organs in the public interest litigation for many years in our country, and further discusses the scope and way of the procuratorial organs participating in public interest litigation.The author will study the following aspects:firstly, the concept of public interest litigation is analyzed; secondly, the comparison method is used to compare and analyze the legal provisions of public interest litigation and the enlightenment to our country. Then, the author introduces the practice of public interest litigation in our country.
