Research On Environmental Justice Specialization Mechanism Of The Primary Court

In recent years, our country’s increasingly serious environmental problems,environmental disputes rapid growth, environmental characteristics of the case itself, the trial put forward high requirements to play the role of environmental justice is extremely limited, these factors gave birth to China’s environmental justice specialized theoretical studies and pilot. However, these individual local pilot from the hierarchy there is more confusion to the practical operation and not standardized, it is arbitrary to some pilot breaking the existing legal institutional framework, and the lack of depth of the system design of the system, the operation is often departing the specialization of the original intention, the function and role play is very weak. Thus, it also suffered from some scholars questioned and criticized. About environmental justice specialized practical needs and the existing legal regime, the author proposed the implementation of environmental justice specialized courts more urgent and necessary perspectives in the primary court, and environmental justice organization dedicated to the implementation of the trial in the presence of a pilot primary courts, the judges, the trial proceedings, the trial mechanism, human resources, financial and supply patterns and other obstacles and difficulties were reviewed and analyzed, for the source of the obstacles and difficulties put forward feasible suggestions to establish environmental justice specialized mechanism in the primary courts.
