Patent Property Pledge Financing

As a new means of financing, Patent pledge financing gets the attentions of thegovernment, enterprises and financial institutions in recent years. In this thesis, theauthor tries to use the law and economics research methods, combining with the practicalworking experience and knowledge, to carry on the analysis of the patentpledge financing question.The purpose of doing this is through an in-depth analysis of theproblem of the asymmetry of patent pledge financing in the presence of supply anddemand, matter ability and risk & return, exploration the influence of constraint pledge legalsystem and economic cost of financing, so as to put forward byinnovation institutionalconstraints, pledge disposal mechanism, establish the convergence center of intellectualproperty services, try to solve IPR pledge financing problem, putting forward opinions andsuggestions for intellectual property services.In the method of academic research, the integrated use of "the exterior" and "efficiencyanalysis" and other common law and economics analysis method to explore the intension andextension of patent pledge financing.Because of the complexity of the patent pledgefinancing and risk is much higher than the financing of tangible assets,the domesticfinancing practice is still at the basic level,and correlation laws need to be further improved.The first part of this paper defines the concept of patent right pledge, and expoundsthe characteristics of financing.The second part introduces the advanced experienceof western developed countries pledge financing and our local practice in the patent pledgefinancing.The third part comprehensive use of economics perspective of matter, legalrisk, value system constraint, economic etc. to improve the last from intellectual propertyservices industry perspective to explore the patent pledge financing mechanism, so as tosolve the difficult problem of financing of high-tech enterprises.
