The Protection System Of The Judge’s Rights And Interests In Taiwan

To realize social equity and justice is an important goal of modern society. An important condition of the realization of social equity and justice is judicial justice which is depending on judges, the key pieces of judicial process. At the center of litigation, every movement of judges is likely to have an effect on the rights of the parties. If lacking of protection of the rights and interests of judges, they are easy to be disturbed by others, thus they cannot in a neutral position. The protection system of the judge’s rights and interests is essential and crucial, it can help attracting high-level legal talent and enhancing the professional quality of judges, promoting the integrity and self-discipline and enhancing the professional responsibility of judges. It is also good for maintaining the judicial authority and fostering legal belief.Taiwan on June 14, 2011, passed the Judges Law, which do the detailed provision of position evaluation, disciplinary action and compensation of judges. These regulations of the protection system of the judge’s rights and interests are detailed and comprehensive. The promulgation and implementation of Judges Law is important realistic significance to realizing judicial independence and justice and improving judicial efficiency in Taiwan, which is also good for developing a judge team of high quality. This paper reveals the importance of the protection system of the judge’s rights and interests by introducing and analyzing the main content and special system of the protection system of the judge’s rights and interests in Taiwan, and introduces the differences between Judges Law and Civil Servants Law by using the method of comparative study, summarizing the advantages and problems of the protection system.
