Social Conflict And Its Management Due To Rural Land In The Background Of Transition Period

For farmers, land is an important means of production, and it is the final guarantee of theirs’ survival. At present, China is in a period of economic transformation, while rural land conflicts continue to occur, which cause quite a shock to the society, and threaten the stability and harmony of society.Land expropriation, land compensation, and contract transfer are likely to pose a threat to land owner’s property rights and the right to survival. At present, land expropriation and compensation is not reasonable, which cause a lot of social issues such as contract disputes, difficult to get strong protection of farmers’ land rights, land disputes caused by the gathering event, and petition. These problems have become threats to social stability.This paper starts from phenomenon of rural land conflict, research the game among the land supplier, demander, operator and hope to find new paths to resolve social conflicts.The Research include five parts: the first part of the paper is introduction, which discusses the background, significance, status of this thesis, thesis research and innovation.The second part of the study related to land conflicts. Elaborates the concept of social conflict from an academic perspective, the concept of land conflicts, causes of conflicts over land and land conflict resolution mechanisms.The third part, describes the countryside conflict caused by land and the conflict of evolutionary mechanisms. Studies have shown that in compensation for land expropriation, land, land circulation, land contract management right in the process, the lack of the anomie and illegal actions, local governments are the main causes of conflicts, land conflicts in evolution is the land supply and demand, the operator trilateral game results.Part four presents basic principles of mitigation land conflicts. Namely the principle of protecting rural lands, the principle of protecting farmers’ rights and the principle of negotiated settlement in accordance with law; and summarizes experience of the United States, Canada and Japan to solve land conflicts, for a reference in our country to solve land conflicts. In Shandong province, Henan province, Guangdong province in China, for example, discussed in solving land conflicts need to be aware of the contents.Part five put the ways to ease the land conflicts. Clear land ownership and make land conflict resolution mechanisms embedded in the agricultural policy; publicly traded, put an end to conflict of land transfer deals; improving laws govern land conflicts and other countermeasures.To sum up, Paper draw five conclusions. First of all, the farmers’ legitimate rights and interests are infringed is an important cause of conflict. The second conclusion is the system failure caused the rural social conflict. The third aspect is that the legal mechanism lead to social conflict. The fourth conclusion, land conflicts in rural areas a growing trend, but that doesn’t mean our country’s agricultural policy more and more unreasonable. The fifth conclusion, conflict resolution must adhere to the principles and implement the rural planning and implementation of the agricultural policy, adhere to the rule of law.
