After signed General Agreement on Trade in Services(GATS), the development of China’s Foreign Service trade has obtained a more remarkable achivement. "several opinions about speeding up the development of service trade" promulgated by The State Council in 2015 clearly pointed out we take great efforts to develop the services trade strongly, it is clearly that our country pay attention to the tourism service trad. Tourism service trade occupies the second important position in service trade, and its important function for China’s economic development is self-evident. That’s the significance and purpose that this article chooses to research the tourism service trade.With the development of global economic integration, international service trade, especially the tourism service trade development powerfully, and the development of tourism service trade in China changes with each passing day. If tourism service trade of China would like to have a further achievement on the world stage, the current law and regulations related to tourism service trade in the domestic shall be gradually improved. However, there are still some deficiencies in the development of current legal system about tourism service trade, even there are gaps about some regulations. So accelerating the construction of tourism-related service trade legal system, improving and perfecting the existing tourism industry and tourism service trade to become vibrant. Under the framework of GATS, the author, from the perspective of tourism service trade legislation, explains the content of our current tourism service trade legal system and problems that have emerged, and puts forward some improvement suggestions for existing problems.There is no doubt that the presentation of the "one belt and one road" policy creates an opportunity for the development of tourism service trade in Xinjiang. The author thinks about the local laws and regulations in Xinjiang, and lists some problems appearing in the local regulations and puts forward some improved suggestions, in order to fill the blank of the special legislation to the tourism service trade in Xinjiang and the improvement of the current local regulations.
