Study Of Law System On Area Protection And Management Of Antarctic Environment

The bleak and still Antarctica has been increasingly the center of attention, influenced by various comprehensive factors such as climate change. Nowadays, frozen territorial sovereignty, peaceful use, environmental protection have been already three basic principles in Antarctic Treaty System. But what’s baffling is that all key issues in Antarctic region have not been still solved. Peoples don’t know how to effectively protect this pure land after the era of Antarctic Treaty. Area protection and management is one of the main situation to carry out environmental protection in Antarctica. It not only demonstrates the resolutions of ATCPs for protecting Antarctica environment to international community, but also proves Antarctic substantial presence of every ATCP and may become the important jetton to restart to compete territorial claims after the era of Antarctic Treaty. This article starts with peculiarity and vulnerability of Antarctic environment on the background of international environmental law, and focuses on area protection and management in the Antarctic Treaty System. What needs to address is whether or not this system compliance with objectives at the beginning of it founded and achieve its aims in the Antarctic Treaty System supported by three basic principles. It could provide beneficial references for protecting Antarctic ecotope all-round.This article systematically analyzes legislations about Antarctic environment protection from two perspectives. First, it researches and analyzes legislative documents about Antarctic environmental protection by the numbers. That is Antarctic Treaty, Protocol on environmental protection to the Antarctic Treaty and its annex and other related international treaties. Second, it deeply researches domestic legislations on antarctic actions in the parts of ATCPs. In the context and background of area protection and management, this article mainly analyzes relevant legislative mandates and implementation about Antarctic environmental protection and execution of treaty of ATCPs, to show the capability of Antarctic actions and the degree of attention of Antarctic environment of ATCPs. At the same time, it wholly summarizes that how to protection are environment of Antarctica for the entire international community, on which basis, it can be used as bedding to ask for information of other countries for China. In the end of the article, it returns to current situation for area protection and management about Antarctic environment of China. Combining with the establishment of ASPAs and ASMAs of China till now, ability to carry out Antarctic activities and execution to the Antarctic Treaty and Protocol on environmental protection to the Antarctic Treaty about area protection and management are in primary analysis, in order to accurately evaluate how to protection Antarctic environment systematically and effectively and growing trend in the future. This research lays the foundation of establishing and improving Antarctic environmental protection centered in area protection and management for china.
