The Mediation Dispute Mechanism Of Akhond In Contemporary Muslim Civil Dispute Resolution In Changji City, Xinjiang

Mosque is one of the main activities of the Muslim.As the mosque’s imam,Akhond is the religious authority who is proficient in the classics and history.At the same time,Akhond also plays an important role in Muslim’s daily life.Changji city is one of the important Muslim communities in Xinjiang. That Akhond, the abbot of the mosque, mediates disputes is an important mechanism among the Muslim community, which has the character of religion, national, formal features. The author investigated Changji City, analyzed the mediation dispute mechanism of Akhond from dispute’s solver, dispute’s type, dispute’s solution, based rules, effect of solution etc. The mediation dispute mechanism of Akhond in Changji City, plays an important role in resolving conflicts, restoration of social relations, but it faces many difficulties in actual development. Muslim tend to choose Akhond to solve disputes,the deep-seated reason is that Akhong mediation meets muslim’s psychology demand for religious and cultural traditions,at the same time it can stand considerations in such aspects as fairness,cost,efficiency as well as social effect. Akhong mediation can effectively make up the absence and insufficiency of the national formal way of dispute settlement in Muslim community,the mediation dispute mechanism of Akhong stll has a lot of space in Muslim community. Akhond mediates daily disputes between Muslim,which has the legality and legitimacy in the level of tradition,religion,legal and reality. We should explore the reasonable positioning of Akhond mediation in diversity disputes in Muslim community,clear the scope and limits of Akhond mediation mechanism,set up the right principles about solving disputes.To the present situation of the mediation dispute mechanism of Akhond in Changji city, when we perfect the mediation dispute mechanism of Akhond,the author proposes some specific operation measures from three aspects:legislation,law enforcement judiciary.The author proposes that we should advance sharia law applicable legalization,strengthen the franco-prussian propaganda,establish the system specification, improve the extensive mediation mechanism etc.
