Legal Research On SCM Agreement’s Impaction Of China’s Aircraft Industry

According to the understanding of the WTO agreement, subsidies is a kind of boost export restrictions on imports of international trade. The SCM agreement in the WTO system is in order to correctly in the regulation of international trade a subsidy, resist the unfair trade practices, as well as unified adjust the formulation of anti-subsidy law with international law formulated by the specification.However, due to aircraft has high manufacturing costs and investment, big risk, long cycle, therefore more or less, relying on government support to development. This paper is to study the subsidies to airbus, Boeing’s case and the SCM agreement terms, after analyzing the SCM agreement to limit and promoting effect of aircraft industry in our country, and puts forward some operational Suggestions.This article except introduction and conclusion, the main text is divided into five parts. The first part mainly has carried on the brief overview to the SCM agreement, first introduced the value concept of the SCM agreement and the system function, then analyses the classification of the SCM agreement on subsidies behavior and identified. Beginning and end of the second part introduces the subsidies to airbus, Boeing’s case of, especially focuses on the SCM agreement in the litigation process and results of two companies the role of airbus, Boeing, as foreshadowing projection on the two sides of the SCM agreement itself. The third part puts forward the problem, that is, the aircraft industry in the field of subsidies are problems and the status quo, in started late, development pace faster under the premise of the airplane manufacturing industry in our country mainly has the following four questions. The fourth part of the SCM agreement as the core, from the positive and negative two aspects analyze the restrictions on aircraft industry in China and promote the role, and focus on promoting effect on the SCM agreement helps draw protection line in China, etc. Finally, put forward some Suggestions on the use of SCM agreement terms, in the elaboration of domestic legislation at the same time, also actively change ideas to update concepts, with reasonable conversion subsidies ways to protect the healthy development of China’s aircraft industry.
