Copyright Protection Of Single Computer Font

The effect of Chinese characters in people’s daily life and work tends to be diversified, not only confined to the exchange of ideas and the promotion of cultural heritage, but also with its form has become increasingly artistic, Chinese characters tends to have aesthetic value, to meet the different needs of the people. And as the product of the rapid development of science and technology, to a great extent,act as a carrier of traditional Chinese characters in the developing digital age, it promote the development of related industries. But, digitization and the development of networks make piracy and tort are becoming increasingly rampant, coupled with inadequate protection of the Copyright law, the development of computer font industry in China is very difficult, and the abuse of single font is more serious. However, in judicial practice, the court tends to identify computer font can be protected under the Copyright law, but single computer font cannot be treat as fine arts works which can be protected by the Copyright law, such as the Founder v. P & G case. The verdict of the case provokes wide attention and discussion in the academic circles about whether the single computer font can be protected by the Copyright law,and people have different point of views. But there also has the court made the opposite decision, such as the case “Xiaoba Xi”. The verdict will undoubtedly make the computer font industry see the light, have hope, and it also have important influences on the protection of computer font and on its innovation and development.There is no uniform legislation and standard in the world to protect the single computer font, protection status in different countries are also not the same, through the analysis of the present conservation status in these regions and countries, can bring judicial practice and experience to our country’s legislation and judicial practice.The aim of this thesis is to have a research of whether a single computer font can be treating as fine arts works protected by the Copyright law, and this thesis mainly use case analysis and comparative study to research. Through the analysis of the originality and discrimination of protected species of the single computer font, the author has the opinion that the single computer font with originality in word stock can be protected by the Copyright law. The author hopes that through the demonstration and analysis of this thesis, can cause the social attention to computer font industry, and hope that our country can protect the computer font as soon as possible.
