Study On Mining Right Transfer System In Our Country

Mineral resources is very important for our country’s economic development.It belongs to the countries at the beginning.As one of the resources which has high value of utilization,just stipulate the ownership is not enough,we must make the value maximize through exchanging,that is mining right transfer.Mining right transfer is allowed in our country,however,it is not free,it needs government’s approval.That is why mining right transfer is not smooth in our country.In addition,there are other problems in the mining right transfer,such as the mining right registration is not independent,special transfer is not allowed.So this paper will focus on analyze the problem of mining right transfer and find solution to solve problem on the basis of elaborating the basic theory.There are four chapters in this paper:Chapter one,overview of mining rights,define mining right accurately,analyze its proprietary nature and the relationship between the mineral exploration right and mining right.Chapter two,analyze characteristic of mining right sale and transfer.The subject is unique,the form is multivariate,its hierarchical approval.Characteristic of mining right transfer is having the corresponding qualifications,the form of transfer is limited and the approval of transfer and so on.Chapter three,analyze the problem of mining right circulation,the problem of subject,government’s approval hinder the circulation,lack of independent mining right registration and so on.Chapter four,the solution to solve the problem of mining right transfer,advocate separate government’s approval from right,change approval system to the registration system,allow special transfer in a way.
