Study On Our Judgement Standard’s Improvements Of Misleading And False Propaganda

Benign competition is good for the economic development under the circumstances of market economy. However, the regulating function of market itself can’t avoid or prevent unfair competition, we need legal regulation. This thesis chooses the misleading and false propaganda among unfair competition for research, focus on the judgement standards of misleading and false propaganda. This thesis can be divided into four parts, the first part deals with the basic concept, characteristics and forms of misleading and false advertisement, making theoretical preparations for the study of judgement standards; the second and third parts mainly discuss about the achievements of judgement standards at home and abroad, analyse our legislation and judicial practice of judgement standards, find the problems among it; the last part sets up the composition elements of judgement standards in misleading and false propaganda, define it from behavior enforcer, subjective aspect, behavior object and objective behavior, and then establishes the core standards in the judgement standards which include quantity standard, overall observation and compare the major component standard, circumstances standard and explanation standard. Hope this can make a contribution to prefect the judgement standards of misleading and false propaganda.
