The Federal Copyright Act initially enacted copyright law in the United States in 1790. It was modified in 1976;the purpose of this act was to encourage the creation of art and culture. During 1976 up until the mid-1990, pre-cloud computing era, the advantage between original content producers and the piracy producers was tilted towards the legal holders; due to their access to the masses. Nevertheless, what was originally the only advantage for the legal holders became, over time, insignificant as the World Wide Web and P2 P services became popular and accessible. This unexpected and sudden shift called for government action at a national and international level. The government in 1996, under Clinton, enacted the Digital Millenniums Copyright Act(DMCA), which oblige countries that traded with the U.S and WTO(World Trade organization) to have controls on dissemination of technology and copyright.However, by having the Digital Millennium Copyright Act unanimously pass Congress it lead to many new questions and ambiguous areas.Therefore, this paper will analyze and review a landmark case, which clarified the direction and role of Copyright law in Cloud computing and will give an educated forecast as to what future implications will the current trend in Copyright law have. Though the judgment didn’t mentioned “cloud computing” at all, the whole decision was made by this technique. The paper begins with the concept of cloud computing based on the case. Then it analyses copyright problems related to cloud computing from two aspects:The challenge our copyright has under the technique of cloud computing, this part including whether or not space-shifting and sampling is judged to fair use and how to use principle of fair use appropriately, how to determine copyright infringement of cloud computing service providers; the chances and the reformation to the develop copyright law in the context of cloud computing...
