Lawsuit Relief Pattern Of Consumer Rights

Consumption drives China’s economic development as one of the troika, it is not only just have a great strategic significance for the development of nation-building, but also an indispensable part of People’s social life. People’s clothing, food, shelter, everything is inseparable from consumption activities. As the state transition from an agricultural society to an industrial society, the development of commodity economy has become more mature, more and more consumer objects and forms, accumulation of wealth of managers are increasingly expanding, increasingly powerful economic forces. Thus, the commodity exchanges in the economy, one is the economy weak consumer groups, the other is a strong economy business owners. Both sides of the game as the two ends of the scale, the operators have more weight, has heavy landing; the power imbalance between the two sides. In this context, how to balance the gap between the two sides, to protect the interests of consumers aggrieved, it becomes extremely important. This article from the perspective of Civil Procedure Law, elaborates Civil Relief way to protect the interests of consumers. Therefore, this paper consists of four parts, namely:Part Ⅰ:expound the basic problem of consumers Civil Relief. By necessity and characteristics for litigation relief patterns as the beginning of the article, explain the importance of Civil Relief pattern to consumer rights.Part Ⅱ:expound two traditional litigation relief ways to safeguard consumer rights, that the individual consumer and the consumer representative action litigation, and discuss their importance and difficulties in protecting the rights of consumers.Part Ⅲ:Public Interest Litigation mode maintains the interests of consumers. Pointed out the significance of this model is built, the connotation and extension and the problem in safeguarding the interests of consumers.Part Ⅳ:The last part of the article, comments measures in order to improve consumer protection civil relief mode, and better safeguard the legitimate rights and interests of consumers.
