Study On The Residual Rights Of The Air Defense Densification Zone

The Air Defense Densification Zone(hereinafter referred to as ADIZ) is a designated area extending upward from the surface of a country’s land or water for the purpose of national security. Within this area, it is required to get the aircraft’s identification, location and control immediately. Currently, more than 20 countries and regions have set up ADIZ, including the United States, Canada, Korea, Japan and so on. With the appearance of maritime security issues, this area raises more and more countries’ attention. China has a long coastline and vast territorial waters, so maritime security is an important part of our national security; meanwhile, with the upgrading of China’s national strength and the growing of international influence, some biased countries launch more frequent intrusion in the aspect of the ocean. Based on this situation, in November 2013, China announced the establishment of the East China Sea Air Defense Identification Zone, for more effective regulation of the aircraft in this area. This movement not only caused widespread concern in the international community, but also caused a huge passion for the ADIZ of the academic research.In the field of international law of the sea, the residual rights have been the focus of academic study. This is because, on one hand, the current system of international law is imperfect; on the other hand, the right space of the residual rights is very impressive, so relevant research can provide great help for national maritime conservation, development and utilization. Within the framework of United Nations Convention on the Law of the Sea and in conjunction with other national and regional legislation and judicial practice,this paper will focus on the research and exploration of the residual rights of the ADIZ and then put forward effective suggestions and countermeasures to our country.
