The Research On Filing And Reviewing Procedures Of The Standing Committee Of Local People’s Congress For Normative Documents

Being a weak link in the work of the Standing Committee of Local People’s Congress, the actual implementation of filing and reviewing work for normative documents are still some way off meeting the original purpose to ensure the uniformity of legal system, which has always been attached with high attention both from theoretical and practical field. Among the considerable researches, the majority of them were focused on the filing and reviewing system itself either through thorough demonstration to the system from theoretical point or evaluation and supplement to specific work content from practical aspects. This paper will focus on the more specific and concrete filing and reviewing procedures from a new perspective. Based on the value analysis of system theory and legal process, this paper takes some existing laws and regulations in different places as research objects, attempting to work out complete filing and reviewing procedures of the Standing Committee of Local People’s Congress for normative documents.This paper can be divided into five chapters. The first chapter defines some relevant concepts and describes the development history of filing and reviewing system of the Standing Committee of Local People’s Congress for normative documents. The second part mainly expounds the theoretical basis of the filing and reviewing system of the Standing Committee of Local People’s Congress for normative documents. The third chapter elaborates value and function of filing and reviewing procedures from legal procedure view. The fourth part briefly summarizes the current setting of filing and reviewing procedures for normative documents in different regions and points out some existing problems. The fifth chapter studies how to set up and stipulate each link in filing and reviewing procedures of the Standing Committee of Local People’s Congress for normative documents.
