Study On The Confirmation System Of Traffic Accidents Of China

It has been nearly six decades since the confirmation of traffic accidentresponsibility was proposed in1950. Especially in the21st century, theconfirmation of traffic accidents has developed rapidly, and various regionshave formulated the rules and regulations for implementation for differentregions in accordance with relevant laws and regulations. However, there arestill many problems in practice, for instance, people even the professionals arestill unclear about the concept and legal nature of the confirmation of trafficaccidents, etc.; many drawbacks exist when the report on traffic accidentresponsibility confirmation is used as evidence in judicial procedures;relevant inspection and appraisal in traffic accident confirmation are notstandardized; the accident confirmation of electric bicycles has difficultiesbecause of the outstanding issues of national standard registration inspectioninsurance and so on. The author believes that these issues are caused by therapid development and changes of social economy, which are the newchallenges generated through keeping pace with the times in the era ofthree-dimensional traffic, and need to continue to be improved and resolvedcapitalizing on the trend.This paper starts from the evaluation and analysis of related concepts oftraffic accident confirmation and elaborates the characteristics, legaldetermination, roles in civil and criminal matters, current situation oflegislation, confirmation principles, existing problems and improvement, etc.of traffic accident confirmation, in order to make a comprehensive interpretation of the confirmation system of traffic accidents of China.
