| Recent years, our country’s life insurance industry develop very quickly with theturnover of this industry increase rapidly, but at the same time the problems on the protectionof the consumers become obvious. The data from the China Insurance RegulatoryCommission shows that the majority of the insurance’s complaints is the case about the lifeinsurance. This paper aims at study how to better protect the consumers’ interests of ourcountry.The first part is an overview of the life insurance. The life insurance mentioned in thispaper is an personal insurance business which put the people’s life as the insurance subject,and regard people’s subsistence or death as the insurance money that has agreed in advance.For a long time, when it comes to the protection of the interests in our country, the insuranceapplicant is the word that usually used, but after the financial crisis, the word financialconsumer becomes popular around the world, and then the insurance industry of our countrygradually uses this concept too. It is generally accepted that the insurance consumers are theobjects that purchases insurance and the objects that be guaranteed by the insurance policy, nomatter what’s the purpose when purchasing the insurance. And life insurance consumers arethe objects that purchases life insurance and the objects that be guaranteed by the lifeinsurance policy accordingly.The second part focuses on the problems that exist in the insurance consumers’protection of our country. This paper summarizes the first four issues of life insurancemarketing, insurance sales, including misleading serious, and so is the staff of life insurancemarketing through deception, concealment or inducing way, the situation of the insuranceproducts or make misleading propaganda behavior described; China’s insurance agencymarketing drawbacks such as personal agent system also produced a series of problems. Then,the life insurance contract terms are often also harm the interests of the King of consumers.Secondly, life insurance regulation as ineffective regulatory objectives are not clear, not cleardivision of responsibilities related departments also cause the problems. Finally, in terms ofdispute resolution mechanisms, in addition to consumer lawsuits have not submitted morerapid and effective way to resolve the dispute.The third part mainly talks about advanced countries and regions’ insurance consumers’ protection mode. This article comes to the three countries and regions. In Taiwanof China, apart from the strong support of the relevant preferential policies, insurance disputesmisleading sales approach and governance aspects such great efforts to strengthen themanagement personnel of insurance up to better protect the interests of consumers in theregion.The fourth part is the author’s suggestions which are made on the basis of the advancedexperience of other’s countries and regions, to aim at solve the problems of the life insuranceconsumers’ protection in China. |
