Researching Of Chinese Military Marriage Protection

The Military Marriage Protection has its own development and meaning. In the earlyyear of Democratic Revolution,in order to handle the whole situation,the legislators madelegal clauses to restrict military spouses’ right of divorcing.Those legal clauses prohibitedmilitary spouses to divorce,and imposed criminal punishment on those inductors andinstigators.Within the development of human concept,Military Marriage Protection has itsown meaning and value for existing in this peaceful period.But its existence not only forservicemen’s right,but for military spouses.Because of the objective condition changes,thedisadvantages for servicemen disappear,the military spouses at disadvantages instead.This paper consists of four parts,except the introduction and conclusion:PartⅠ,start from two typical cases about military marrige:one is the serviceman betrayhis marriage because of living separated from his spouses;another is the servicemanmisunderstands his wife and the faith among they two disappear,then their marriage breaksup.But because of the Military Marriage Protection,the two military spouses have difficultiesin divorcing.Part Ⅱ,it’s a description of our Chinese Military Marriage Protection.It consists thedefinition of marriage form for Military Marriage Protection—that is only one person isserviceman between the spouse.And list the certification of serviceman.Then,introduce thehistory and trend of Military Marriage Protection.Part Ⅲ,the meaning and problems of Military Marriage Protection:in the law system,theregulations about servicemen’s serious faults aren’t clear;the clauses about Military MarriageProtection have contradictions with the constitution;it’s hard to judge whether the militaryspouses break up;the military spouses who have no faults have difficulties in asking forcompensation.Part Ⅳ,the idea of complete Military Marriage Protection.It consists the measures ofstrengthen legislation and judicial practice,modify policies according to combining Chineseactual situation with foreign advantages,to establish a comprehensive Military MarriageProtection system.
