But, our country present about criminal case supervision legislation is not perfect, the main existing single supervision object, the narrow scope of supervision, supervision means fatigue defects. At the same time, in judicial practice, there are also many problems and difficulties, mainly in the case of sources and channels are sluggish, start condition hard to reach consensus, legal supervision is ineffective, etc. The author tries to combine the practical work, from two aspects of theory and practice of criminal case filing supervision system, and to further perfect our country’s criminal case supervision system and put forward some thinking. In the legislation, mainly is the need to increase the supervision of criminal record object, expand the scope of criminal case filing supervision, strengthen the supervision of criminal record means. In practice, mainly through the supervision of criminal record sources of clues to broaden, clear to start criminal case supervision conditions, specification of criminal case filing supervision procedure. To further improve the suitable for China’s national conditions and judicial characteristics of criminal case filing supervision mechanism, promote impartial and honest law enforcement, to enhance the credibility of the judiciary.
