On The Protection Of Consumer Rights And Interests Of Law Contract In The Network Group Purchase

In recent years, with the rapid development of economy and the Internet, E-commerce transaction has constantly updated. Network group purchase, Like blustery, is developing rapidly in network market of our country, for its openness, the characteristics of convenience, low cost and high efficiency after the rise of abroad. However, there is the increasing number of trade disputes followed by group purchase. At home, group buying is neoteric things which emerged in recent years, but its market operation mechanism is still very immature. Combined with the network consumers’ rights and interests protection legislation lag, to protect the rights and interests of consumers in the network group buying has many obstacles.In this dispute, as consumers have the nature of network consumers and entities at the same time, dealing with disputes of legal is becoming more complicated. The traditional law for consumer rights and interests protection, in this new field of the network group buying, is a problem to review and face.This article, researches and analysis the rights protection in network group purchase consumer in our country mainly from three aspects. In the first part, we would like to difine between network group purchase contracts and their subject interests.First of all, four aspects are analyzed, which are analysis of network group purchase contract legal relationship, the concept and definition of network group purchase,the difference between Network group purchase and the way of traditional group-buying, and Network group purchase subjects. Secondly, analysis the characteristics of the subject interests in network group purchase contract. The second part, if there are some shortages of the protection of consumer rights and interests in network group buying, we would analyse respectively from "the law of consumers’ rights and interests protects","contract law "and relevant judicial interpretations. The third part,for the second part in the shortage of the protection of the rights and interests of consumers, gives more impeccable suggestions.
