The Regulation With Criminal Law For Disseizin Behaviors Upon Real Property

Since1993, the Government encourages the purchase of public housing, and promote the commercial housing. In1998, the Government stop welfare housing distribution across the country. That Forces people to buy real estate in order to improve housing conditions. With the steady progress in economy, the requirements and concern level of living housing is increasing. Accordingly, the increasing number of disputes related to housing and other real property. However, the current civil law system gradually be weaker against serious actions violating the rights and interests of real property such as seizure of houses, and unable to provide the obligeewith quickly and effectively appropriate relief. This thesis suggests that most effective way to solve that problem is to strengthen the criminal protection of real property, in order to regulate disseizin behaviors upon real property with criminal law.This thesis will proceed from the concept of disseizin at first to discuss the type of disseizin behaviors. Secondly, under full reference and analysis of foreign legislation about disseizin behaviors upon real property, this thesis will suggest a more scientific and reasonable plan to improve our criminal protection of real property, that’s to set up disseizin crime. Finally, this thesis will briefly state the constitutive, specific behaviors, relationship with other crimes and legal sentence ofaforesaid new crime.
