During the course of industrialization and urbanization, the land demand is strengthened,the existing state-owned land can not meet the development of urban and infrastructure construction,therefore,the Government only by way of collection,conver rural land to various of construction land, in order to meet the needs of the land market.Because the system of land expropriation comes into being in the period of plannede economy,many problems are exposed is the process of the land expropriation. For some historic reasons and with the effect of tradition,nation interest has been considered excessively while private profit less respected so that land expropriation has been abused. caused various social problems,farmers protest and Pteition phenomenon often occurred.In china,furthermore,there is an obvious abuse of land expropriation power,which leads collective and peasantry’s interests unprotected.From the perspectives of assorting with public intetests and private ones,especially,protecting the peasnty’interests.This thesis begins with the theory of the expropriation and demoliti-on,present situation of the rural expropriation and demolition, then points out the fla-ws existing in the present legal system of the rural exipropriation and de-molition.Referring to the oversea’s advanced experience, this thesis brings forward some sugegesetions to make the legal system of the rural ex-propriation of land and demolition of house perfect.Improve the legal system to protect our legitimate rights and interests of farmers whose land is conducive to social stability and progress, In order to better protect the rights and interests of the peasants.
