Legal Countermeasures Research On China’s Rural Labor Shortage Under The Background Of Hollowing Out

The problem of rural labor shortage is accompanied by the flow of rural labor force andthe flow of the rural labor force is a experience in the course of modernization developmentstage which a country must experienced, reflecting the national trend in the process ofindustrialization. Many Chinese scholars have affirmed the positive role played by thedevelopment of rural labor mobility on economy and society in rural areas, but ignored thenegative impact of rural labor shortage makes inpositive effect the development of ruraleconomy. With a large number of "culture,skilled, good at management" labor move to cityfor business, agricultural labor shortage has become more and more serious. Rural labor is notvery high quality, there is a clear "aging" and "feminine" trend, many places where supportagricultural production is the women, old people and children, which seriously restrict thedevelopment of modernization of agriculture in our country. This paper, in addition to theintroduction and conclusion, is divided into four parts for research of Legal Countermeasureson the shortage of rural labor in China.The first part introduces the connotation of hollow, respectively from the geography,economics, sociology, and then the author prefers the conclusion that since the1990s, withthe social economy developing, constantly advancing of industrialization, urbanization,withquite a lot of cultural, skilled workers pouring into the city, rural hollowing out means thevillage layout changes, some rural population structure and industry structure changes, as wellas the new rural problems and new phenomena.Finally it explains the relationship between thehollow and rural labor shortage.The second part, the author thinks that the shortage of rural labor of our country is a kindof functional shortage, and describing its qualitative and performance. divides into the Labourshortage of functional disorder labor shortage and structural shortage, and in combinationwith analyzing the present situation and problems of China’s rural shortage, finally it isconcluded that the direct cause of the functional shortage of rural labor is the rigidity of themarket function, and detailed analysis from five aspects.The third part, a detailed analysis of China’s rural labor force function shortage causes from the aspect of law. First, the urban and rural dual system set a barrier for labor flow.Second, fiscal and financial policy of imbalance causes loss of rural labor force. Third, thehousehold registration system of unreasonable arose labor resource allocation injustice.Fourth, regional economic imbalances disguised to widen the gap of rural labor force. Finally,the social security system is not sound exacerbated the vicious cycle of human capitalaccumulation.In the last part, according to the reasons of China’s rural labor shortage, puts forward theconcrete measures. The author thinks, through system innovation of rural labor shortagecauses, will attaching to social security, employment and education, land, finance and otheraspects of the differences between urban and rural areas belong to the household registrationbecomes weakening and even tend to little, then, young workers will return, structuralshortage also gets up. At the same time, the labor relationship will be more harmonious,people’s life will be more dignified, urban and rural society will be more fair,"China dream"will be realized at an early date.
