Research On The Enterprise Legal Management Of The Demand-oriented Prevention And Control Of The Legal Risks

In the30years of Reform and Opening up, China has undergone tremendous changes inthe economic environment, characterized with the gradual establishment of the socialisticmarket economy system, the gradual improvement of corporate governance structure based oncorporate system and the subject of the enterprises of our modern market economy. In themeantime, the socialist legal system in our country has initially established, the socialist ruleof law gradually highlight its advancement and scientificness and enterprises are exploring theway of development in accordance with the thoughts of rule of law and methods. The practicehas proved that the old management mode fails to adapt to the modern market economy andlegal environment, and the enterprises must strengthen the management, especially thelegitimate and effective prevention and control of enterprise legal risks and improvement ofthe enterprise legal management.Since standing in the forefront of reform and development, China’s enterprises mustexplore and seek more effective development way, and can get twofold results with half theeffort. How to effectively implement the enterprise legal management and control ofenterprise legal risks? The author holds that we cannot be too observant of conventionalstandards, nor do beam on the stereotypes, and we must explore the driving forces from theinternal management. Need is the fundamental driving forces of enterprise management. Theenterprise legal management originates from the prevention of enterprise legal risks, whichshows the internal demand for legal management of the enterprises. Only when legalmanagers in each stage can comb and identify the enterprise’s internal legal requirements canmore successfully implement the management,“build up establishment”, make achievementsand have a position in the complex field in the enterprise management, and legal managementcan create profits for enterprises from the level of the rule of law. The author hopes this thesiscan serve as a modest spur and receive the criticism and resonance of colleagues.
