China’s economy has enjoyed rapid development since Reform and Opening-up. Economic development led to the movement of people, which made more and more minority people left their hometowns for developed metropolises. According to a rough estimate, at present there are more than 20 million minority population scattering in cities, which accounts for 11.7% of the ethnic minority in the whole China. As an important group, their movement to cities is an inevitable result and a manifestation of economic development and social progress in our country, which not only partly eases the lack of labor force in cities and provides motive for development, but also contributes to their acquirement of new knowledge, thought liberation and living standards improvement, which helps to promote national unity and society harmony. At the same time, the minorities remain their distinctive traditions and characteristics, thus they are different from the rest in the cities where Han people being in the majority. Coming from various places, living in different urban areas, belonging to diverse ethnic groups and with different ethnic background, they are faced with many problems in rights protection. At present the protection of minority rights in China’s laws is focused on the compact communities, while the protection of scattering minority especially who live in cities is still very weak, which needs to be further improved and perfected.This paper first introduces the basic theory of urban scattered minorities’ rights, distinguishes the concepts of ethnic minority, scattered minorities and urban minorities, then analyzes the nature of city scattered minorities’ rights, discusses the necessity and urgency of protecting them, and finds the legal support of protection from the three perspectives of universality of human rights, special protection of equal rights and the right of development. At last, aiming at the prominent problems in protecting urban scattered minorities’ rights since China has entered the New Period, drawing lessons from the international community and other ethnic countries’ experience of dealing with ethnic problems, combined with China’s situation, this paper tries to explore the specific countermeasures and suggestions to solve the problems, in order to better protect urban scattered minorities as a disadvantaged group in our country.
