The Draft Amendment To Criminal Law(9th)on The Modified Evaluation Of Bribery Crime

With the deliberation of “The Draft Amendment(9th) to Criminal Law” conducted by Standing Committee of the National People’s Congress, legislation process of bribery crime develops forward in our country. In the draft, multiple amendments were made for relevant bribery crime terms in “Criminal Law”, from these amendments we can tell that criminal legislation of bribery crime is overall becoming stricter and severer, the punishment power is strengthened and the nation’s determination against bribery crime is obviously shown. However, there are still some shortcomings in criminal legislation of bribery crime. The paper started with amendments of “Amendment to Criminal Law”, characteristics and functions of amendments were analyzed, legislation evolution and development of bribery crime in our country were researched, “The Draft Amendment(9th) to Criminal Law” was deeply studied and considered, current status, existing problems and reasons in bribery crime legislation were explored. About suggestions for relevant bribery crime legislation in China, common bribery crime problems were considered, the author believes that the range of bribery criminals should be widened constantly and that punishment design of bribery crime should be optimized and improved. Suggestions were provided on two aspects: conviction and measurement of penalty of two key accusations of bribery crime-- offering and accepting bribes, the author also advises to delete the rule of “seek profits for others” in accepting bribes crime, establish independent standards, delete important condition of “seek improper profits” for offering bribes crime, build clear punishment framework for offering bribes crime, fulfill goal of improving criminal legislation system of bribery crime and developing law net, so bribe crimes can be fought efficiently and spread of bride atmosphere can be stopped.
