The Study On Sino-Vietnamese Transnational Marriage Application Of Lawy

With the continuous development of international economy, especially the acceleration of economical integration the frequent Interpersonal relations from different domains as well as the increasing of international exchange, transnational marriages have been increasingly developing. in recent years, the international exchanges between Sino-Vietnamese relations are also developing, the phenomenon of Sino-Vietnamese border residents intermarriage is more common, but due to the cultural and law differences,a lot of practical problems remain to be solved, especially those concerning the differences in law between the two countries, Being a college student in Guangxi, the writer has the advantages of studying the problems.There exist great differences concerning the laws between the two countries, and no bilateral agreements have been reached so far, the writer studies thoroughly the Sino—Vietnamese transnational marriage from the angle of the laws, and give some suggestions about the confusing intermarriage relations and try to find effective solutions to the problems.Starting from the current historical situations between the two countries and on the basis of comparative analysis, the writer analyzes the conflicts in the law using the methods of comparison and documentation, thus improving the Sino-Vietnamese intermarriage relations. On how to find out the reasonable solution of the transnational marriage law conflicts between the two countries and their applicable law problems put forward some suggestions.There are four parts altogether:Introduction:about the study background, meaning and current study situation concerning the problem as well as some areas to be improved. Associated with paper introduced the domestic and foreign research situation about China and Vietnam transnational marriage problem and analyzed, pointing out the importance of the application of law in Sino-Vietnamese border residents intermarriage.Firstly, the history and current situations of Sino-Vietnamese border residents intermarriage are analyzed. By looking back on the history and basic characteristics of the Sino-Vietnamese border residents intermarriage and social and law analysis, provided for in the overall cognitive transnational marriage, the writer lays a foundation for the remaining parts.Secondly, the reasons for the conflicts in intermarriage between the two countries are analyzed by comparison to highlight the necessity of solving the problem. Through the marriage law of China and Vietnam, including the marriage law, law and other relevant laws and regulations, especially in the condition of marriage and divorce laws and regulations and procedures detailed comparison to highlight the necessity to solve the problem of conflict of laws.Thirdly, the approaches to the solution of the problems of Sino-Vietnamese border residents intermarriage are analyzed directly as well as indirectly, pointing out the current shortcomings,offering the realistic basis for the solution to the transnational marriage.Fourthly, on the basis of the above-mentioned parts, solutions are put forward including the unification of conflict of laws and Uniform substantive law as well as strengthening the judicial cooperation between the two countries, Seeking a proper solution of Sino Vietnam transnational marriage law conflict problems, also for other countries and regions on the relevant problem in order to provide the beneficial reference.The last part is the conclusion. On the summary of the full text, the writer’s opinions are further illustrated about how to coordinate the problem concerning the conflicts of the Sino-Vietnamese law bilateral transnational marriage relationship by appropriately referring to the styles in other nations or regions concerning the transnational marriage law conflicts, thus offering the complementary recommendations to perfect the application of the cross-border marriage law.
