On The Protection Of Freedom Of Political Speech

The core content of freedom of speech is the freedom of political speech which has special value such as reflecting personal political value, realizing power supervision, promoting the concept of public reason and promoting the development of democratic politics. At present, the understanding of freedom of political speech in our country is not enough. Not only the lack of academical research but also the lack of awareness shows that that the concept of political speech is not deeply rooted in the hearts of the people. The provisions on political speech is not much in legal text. There is lack of the provisions of restrictive protection and clear protection about the freedom of political speech in the constitution. There are also some questions such as the tendency of excessive intervention of political expression, the large number of penalty provisions and the vague provisions in the criminal law. The phenomenon of violating political speech in the practice is not ignored and many cases should be reflected. It is imperative that the enlightenment of concept of political freedom is needed. In addition, the integrity of the legal norms and the practice of the concept of political freedom should take the responsibility. The protection of freedom of political speech relies on the four aspects of carrying forward advanced ideas, establishing effective principles, enacting reasonable laws and promoting the rational practice.
