Mobile Payment Regulation Legislation Research Of China

With the progress of mobile communication technology in China, mobile payment is the darling of the mobile Internet era and become the biggest bright spot in the field of electronic payment. Users use mobile terminal equipment such as a mobile phone, PAD, PC and so on. The advantages of mobile payment is without being limited by the space and time and pay in fast and convenient, wide coverage and anywhere. Mobile payment has brought great benefits to the users, mobile operators, commercial Banks and non-financial payment institutions. But mobile payment also produce the corresponding payment security, protection of the rights and interests of consumers and related financial risks, legal disputes and other issues because of hacker attacks, particularity, regulatory legislation is not sound. This paper introduces the mobile payment development, analysis the benefits of mobile payment development, problems and reasons, and analyze the problem of mobile payment regulation legislation in our country. From the point of view of global mobile payment regulatory legislation, some countries have extraterritorial mature legal system and regulatory approach which promote the safety, reasonable and orderly manner of mobile payment. This paper infrastructure regulatory legislation that based on other country mobile payment regulation legislation:establishment regulatory legislation pattern, clear regulation of mobile payment system, the principle, straighten out the main body in mobile payment supervision responsibilities, regulation and supervision in advance, matter later add some special regulatory system to ensure the safety, efficient and healthy development of mobile payment in China.
