The court mediation, as a system with. Chinese characteristics in China’s civil procedure law, which began in the new democratic revolution, adapting to the reform and opening up of Chinese society, once played an important role in resolving conflicts, maintaining social stability, and promoting economic development. It was up to the condition of social life at that time which included but limited to the planned economy, collective interest predominated, stable residence, simple laws and ignorance of rights. However, with the ongoing of socialist market economy and legal system construction, the traditional court mediation system was not satisfied with the development of economy and social life, exposed its limitation and weaknesses.It is necessary to improve and develop the court mediation system. In regard of this, a system should be built to achieve the function and social effect of the court mediation, which combing pretrial mandatory mediation with strengthened mediation in trail. The paper proceeds from the nature, status and value analysis of civil court mediation system, focuses on analyzing the existing problems of the court mediation system, and emphasizes how to improve the principles and specific operation.
