Research On The Current Situation And Prevention Of China’s Internet Fraud Crime

At present, in the condition of internet information technology progressed rapidly, Computer network is penetrating into every corner of life gradually and bringing a lot of convenience to the people. But in recent years, internet fraud is springing up, and causing a great damage to the whole society, and threatening the safety of people’s property. Compared with traditional fraud crime, internet fraud has unique feature of wide spread, stronger disguise, low cost, high technology content, the subject of crime younger and so on. Because the number of internet users in China is huge, so the internet fraud problems are very serious. Combined with present relative laws and rules in our country, and researching the way of expression of Internet fraud, looking for an effective method of fighting Internet fraud crime will make a great significance to the safety of society and netizens’property.The paper is divided into four sections to analysis our country Internet fraud crime.The first section start from the concept of Internet fraud crime, analyzing the pure and impure Internet fraud crime, comparing the traditional fraud crime and Internet fraud crime from several aspects, analyzing the characteristics of Internet fraud crime. In the final part of this chapter, summing up and analyzing the various manifestations of Internet fraud crime, introducing relevant cases and showing the forms and means of fraud crime.The second section is about the legislation of Internet fraud crime in our country and application of legislation, by combing the relevant laws, analyzing application of relevant laws, dividing Internet fraud crime into disposed according to the traditional criminal law and do not disposed according to the traditional criminal law and dealing with inappropriate according to the traditional criminal law, laying a foundation for the opinions after the text.The third section is the difficulties of fighting Internet fraud crime facing. Based on the reason which the Internet fraud crime is a new form of crime, analyzing the difficulties of accreditation, detection work, investigation, arresting and ordering the recover ill-gotten gains.The fourth section is countermeasures of preventing and combating Internet fraud crime. Combined with the analysis of above sections, summarized and make suggestions which perfect the legislation, strengthening the supervision of the network security, strengthen industry standards, strengthening awareness of propaganda and strengthening international cooperation.
