Public Scrutiny’S Restrictions On Executive Power

Executive power is a kind of state power directly bound up with citizens’ immediate interests, also most changeable and easy abuse to cause prejudice to social individual. For one reason, it rests upon its own characteristics. For another, it exercises in relation to the perfection or not of the relevant supervisory system. How to control excessive expansion and mightiness of the executive power is a big topic with high concerns in today’s world. In light of our current political structure, no power control system like separation of executive, legislative and judicial powers in western counties, the control power comes from various supervisions of all fields, while public scrutiny is one of the effective ways, which enjoys disparate advantages in comparison with the other modes of supervision as a main form for public to express wills openly, influence on public decisions and supervise power exercising. The article focused on the research on the nature, characteristics and the other elements of public scrutiny and the analysis of current situation and problems, probed into the way of the enhancement of the restrictions on executive power through public scrutiny and finally made relevant suggestions. The enhancement of public scrutiny for the control of executive power helps to play media’s role as a potential "the fourth power", deepen anti-corruption campaign and promote political civilization of socialism. It is the only way of building a democratic society under the rule of law.Different countries, different regions, the size of government affairs and interfere in the field of wide and narrow will be very different from the executive power that also have a corresponding difference. Executive power, refers to some of the main executive for the completion of its administrative tasks to carry out its administrative duties in order to achieve the country’s administrative functions under the Constitution and laws mandate enjoyed by the management of the country’s political, economic and social affairs authority. As the executive power with a mandatory, dominant, the priority of the basic characteristics, as well as the exercise of executive power in the course of the operation and there is a strong permeability and relatively broad discretion, which determines that it is related to the vital interests of the citizens of the most closely related to a state power, which is the most dynamic, most vulnerable to abuse the law or society and the individual most directly against a state power. Over-expansion of executive power and a strong will automatically generate the result of alienation to the inherent nature of being against unscrupulous to strengthen and enlarge, on the personal, social and healthy development of the national cause immeasurable damage.Today strengthening the executive power constraints,which has become the consensus of all countries in the world, the poor are only taken by the specific way different. Supervision by public opinion as a constraint of the executive power is an important way to play its role what has become increasingly evident. China is a country representative, the establishment of the highest representative body-the National People’s Congress and its Standing Committee and local People’s Congress Standing Committee and its corresponding, but the West did not principle of separation of powers. Although China is also the state power into legislative, executive and judicial powers of the three powers, which don’t among the three powers of mutual checks and balances relationship, but the division of labor relations in pursuit of harmony between the state power. Therefore, China’s constraints on executive power mainly through the supervision of the implementation of this way.In this paper, constraints on the executive power of public opinion about the issue was discussed and put forward a number of shallow views and recommendations of the limited level of oversight of the inevitable. In any case, this issue deserves an in-depth academic studies to better guide the practice of public opinion through the media, the right to administrative constraints to further improve the mechanism and system, strengthening the executive power constraints, and promote the transformation of government functions, building harmonious society.
