Studying Of The Independence On Sentencing Process

Independent sentencing reform program of judicial reform is a major initiative and establishment of an independent sentencing procedures is an inevitable trend of history.We shall actively confront the legislative and judicial.Although reform of the sentencing process in the early achieved certain results,but the reforms still need to be careful, prudent and phased actively promoted.Our independent sentencing procedures yet to be perfected,in the future path of reform we should strictly adhere to the concept of justice and procedural justice and considering the reality of our country in the specific program design.At the same time,we also need to learn the advantages of other countries and regions.To establishing China’s unique independent sentencing procedures.This paper introduces the independent sentencing process of the necessity and inevitability at first,then examines the two legal systems of major countries of the sentencing process.Immediately after this paper summarizes the process of China’s current sentencing procedures and the difficulties confronted by our current sentencing procedures.Finally, the author make the support mechanisms to build recommendations of the independent sentencing process.
