Studies On The Legislation On The Circulating Economy In Chongqing

It is well-known that since the reform and opening-up in 1978, China has made great and unprecedented achievements with economy soaring and social development. However, owing to the dependency on the traditional economy development mode, the problems of insufficient resources and worsening environment are also subsequently arising and becoming increasingly worsening and the social durable development is becoming increasingly weak. In order to change this situation, it is imperative to seek a new economy growth mode. Under such background, circulating economy is introduced from the foreign country and gradually comes into the people’s horizon.Circulating economy is the fundamental change to the traditional extensive growth mode of high-consuming, high-effluence and low-efficiency. In comparison with the traditional plundering economy which brings the heavy economy burden to resources and environment, circulating economy is able to obtain the greatest possible economy interests and social interests by promoting the usage efficiency, reducing the waste effluence and reducing the environmental pollution and ultimately realize the stand-by-stand development of economic development and environmental protection. The transformation from the traditional economic development mode to the circulating economic development must be supported by the law. Our country has gradually promulgated the special legislations on circulating economy. After the maturity of all conditions, our country promulgated the Law of the People’s Republic of China on Promoting the Circulating Economy, which for the first time established “3R principles” of reduction, reusing and resource for the operation of circulating economy and also defined the fundamental legal systems for the development of circulating economy.Chongqing was once the most important industrial bases in China and the traditional extensive growth mode of high-consuming, high-effluence and low-efficiency still plays importance role in the current economic development. Faced with various problems of insufficient resources, environmental pollution and ecology recession, it is urgent and inevitable for Chongqing to implement circulating economy for the durable development. In order to support the development of circulating economy, Chongqing promulgated the regulatory document of the Decision of Chongqing People’s Government on the Development of Circulating Economy(2005) and also issued a series of supporting systems. However, after several years, circulating economy in Chongqing still steps into the legalized road, which greatly affected the construction of circulating economy in Chongqing.In recent years, under the leadership of the municipal communist party committee and municipal government, circulating economy in Chongqing has achieved outstanding achievements, relevant policies and legal system has initially improved and the basis for local legislation on circulating economy has been in place. Consider the lack of local regulations leading the circulating economy in Chongqing and the fact that the Regulation on the Promotion of the Development of Circulating Economy was incorporated into the legislation preparation item in 2009, 2010 and 2011, it is required to promote the promulgation of the Regulation on the Promotion of the Development of Circulating Economy designed to promote the development of circulating economy.
