Since the Criminal Law Amendment VIII brings the dangerous driving behavior into China’s criminal law, it has produced a positive social effect. But problems exposed deserve serious attention in criminal judicial practice, such as unreasonable prescribed punishment disposition of dangerous driving crime, simple behavior mode and difficult choice in charge of deadly consequences and so on. Dangerous driving firstly originates from abroad. Especially civil law countries made detailed regulations on it. More typical countries are like Japan and Germany. In Japan, its criminal law regulation of dangerous driving has been revised for several times, which is more systematic and comprehensive. It is officially formulated and passed Death and Injury Behavior of Motor Vehicle Driving Punishment Act in November 2013, which makes some corresponding revision and improvement to the provisions of the dangerous driving death or injury results in original criminal law. And it newly establishes some content including free taking off and aggravated punishment of driving without a license. It makes more specific and detailed rules on problems in the dangerous driving behavior, legal sentence configuration, and the casualties of charges application caused by dangerous driving. It is helpful to make analysis about dangerous driving criminal law in order to make some enlightenment and reference to Death and Injury Behavior of Motor Vehicle Driving Punishment Act.Our legislation design and accusations of dangerous driving crime need s to be further improved as well as its charge which aims at make the criminal responsib ility of dangerous driving crimes more reasonable and accurate.
