Analysis On Perfecting NPC’s Legal Supervision System On Government

Both the partite political system of Western countries and the NPC system of China attach great importance on supervision of the executive power at all times and in all countries.The essence of NPC’s supervision on the government is an inevitable demand to guarantee people’s interests by carrying out their own rights. The highest standard of NPC’s supervision on the government is to meet the interests of people.The legal supervision and legislation and other behaviors of government must protect public interest and guarantee people’s rights. China’s of National People’s Congress on the government’s lies in mainly two aspects of legislation and law enforcement supervision through ways of hearing and deliberating work reports,inquiry, recall and cancellation and change of laws and regulations. Our country has regulations of NPC’s legal supervision of the government, but in practice the role of supervision of NPC is extremely limited. "Legislature of Western countries’supervision on administrative organs mainly performed through three modes, including the British authorities supervise mode, the US general court-supervised model and the specialized agencies of Germany and France’s supervision mode".Studies of these three classic mode will inspire the perfecting our country’s NPC’s supervision system on government. The supervisory role of the government of our country’s NPC is not effectively play has many reasons, lack awareness of supervision, imperfect of NPC deputies election system, Chinese power structure model which led to the over-strong of executive power and the unclear of government responsibility. So how timely and effective trace and clean the root cause of these problems and proposed solutions to this problem in the legal aspects is an important measure and proper meaning on perfecting the executive power of the NPC’s supervisory system on government’s power execution.
