"Anti-Counterfeiting Trade Agreement" was participated by the U.S, Australia, EU, Japan and other developed countries aiming to make an agreement negotiation for improving the standard of international intellectual property protections. There are six chapters in this agreement, including the initial provisions and definitions, legal framework for enforcement of intellectual property rights, enforcement practices, international cooperation, institutional arrangements and the final terms. Relative to the "Agreement on Trade-related Intellectual Property Rights"(short for TRIPs), ACTA is aiming to improve international intellectual property enforcement standards to a new level. China’s protection of intellectual property rights has kept pace with the TRIPs Agreement. Compared TRIPs with ACTA in the civil enforcement, border measures, criminal enforcement and enforcement of IPR in digital environment of the differences, this paper tries to provide a reference for the protection of IPR. The paper is organized as follows:The first part:Overview of the Anti-Counterfeiting Trade Agreement, which mainly describes the background of the ACTA, the main content, its characteristics were summarized and the current state of the ACTA progress so as to have a good understanding of this paper.The second part, by comparing the TRIPs Agreement with comparative analysis of intellectual property enforcement TRIPs Agreement from the civil enforcement measures, border enforcement, criminal measures and the digital environment Anti-Counterfeiting Trade Agreement, finding the difference between ACTA and TRIPs.The third part, analysis the effect of ACTA to the government and enterprise, and provide corresponding routes for Chinese IPR enforcement.
