| Summary:In Mongolia, the issues to perfect the mineral special permit laws are in slow progress to be solved. The current economic activity speed and the said laws do not harmonize with each other in many aspects, but the mineral laws are being perfected. Nowadays, the concept about the minerals and the law related their properties are too general, containing less details and having a lot of defects. Accordingly, this law is not implemented efficiently. Also, the mineral evaluation law is not good enough and the related evaluation methods are not perfect. Although pledging of any mineral special permit is recorded by the higher authorities, there are insufficiency of mineral special permit management and organizing means. Therefore, at first it is necessary to study the properties of mineral special permits in order to draft particular laws about mineral special permits. By studying the properties of mineral special permits, it will be able to draft particular laws harmonized with their each feature, supporting the duty fulfillment of the Government and protecting the rights of mineral special permit holders. The first part of this written work mentions the previous history about drafting laws related to mineral special permits. The last part consists of some studies about mineral special permits. In Mongolia, mineral special permits are divided into two categories:special permits for mineral exploration and special permits for mineral mining.The holder of a special permit for mineral exploration receives a special permit for mineral mining after doing exploration and determining the related resource level/s. A special permit for mineral mining can be pledged. In addition, special permits for mineral exploration and mining can be transferred to someone else under the Mineral Affairs Law.When raising funds by pleding a special permit for mineral mining, a secondary market emerges for the holder of the mineral special permit. The rights of mineral exploration and mining are named mineral special permits. Furthermore, types of putting mineral special permits in circulation can be joint ownership, joint cooperation, empowered mining, partial mining by empowered parties and corporate share trading in stock markets, including pledging and transferring,.So, in this written work, I aimed at studying about putting mineral special permits in circulation, properly organizing special permits for mineral exploration and mining, drafting the relevant laws, significantly promoting in the home country, correctly developing the mineral market of Mongolia in an arranged manner and preventing cheating business entities, which use legislation defects, from unfairly exploting minerals. |
