Study On The Improving Path Of Judicial Credibility

The public trust to the judicature is just like the belief to the law. The law lack of the belief is nominal; judicature lack of the public trust does not form the due authority of legal relief, hardly produce visualize of legal equity and social justice. Under the background of prominent contemporary society credit crisis, the judicial credit crisis is a much more prominent and serious part. For example, people do not trust the judicature, all kinds of petition cases emerge in an endless stream, judgment enforcement issues are unable to effectively alleviate. People seek various extrajudicial means to resolve the dispute, and so on. Judicial credibility is the guarantee of judicial vitality and the most essential requirements of justice. Therefore, at this stage, we should deeply study the situation of the judicial credibility in China, and analysis the reason of this phenomenon, and seek the improving path of judicial credibility on the basis of it.This article includes two parts, introduction and main text. In the introduction part, the author makes an overall elaboration of the background of the article’s topics, the research status of judicial credibility, the author’s research content and method in this article and so on. In the body part, the author firstly makes an introduction of the improving path of judicial credibility, including the concept of justice and judicial credibility, the component element of judicial credibility, and the background of the improving path of judicial credibility; then the author evaluates the level of judicial credibility by analyzing the famous "Li Changkui case" from the theoretical and the practical aspects, drawing the conclusion that our country’s judicial credibility level needs to be improved, and then analyze the reason of the above phenomenon and put forward to some improvement measures. The innovation point of the article is that the author tries to analyze the reason that our country’s judicial credibility level needs to be improved from the aspect of judicatory with administrative characteristic, judicial independence and so on, and focus on the improving path of judicial credibility in the finally three parts.
