We live in a world of symbols, we create symbols and we know the world through symbols at the same time. Symbol is a tool for people to espress their feelings and we also can study ideas and culture from the symbols. Therefore, it is necessary for us to study symbols. With the continuous development of judicial reform and the implementation of the rule of law in our country, a lot of symbols are introduced. Symbols play a real important role in our judicial reform and show the judicial philosophy to people.“Ritual guards the portals of the sacred, and one of its functions is to preserve those taboos essential to an ongoing society through the sense of awe that ritual invokes. ” through the judicial ceremony, which combined symbols, we can see the operation of the judicial process, we can realize the change of judicial route, we also can feel the order and authority of the law. The promotion and use of the gavel is expansion to the judicial culture, and the use of the gavel also can guarantee the judicial ceremony smoothly. Some people think that the gavel is Western thing, someone say the gavel is originated in china. There are a lot of problems in the actual process of using the gavel, like disobey the rules of using the gavel, knock mallet casually. These problems are a reflection of the limited attention to the judicial ceremony and lack of the knowledge of law. The gavel in mainland China is the basis of this paper, from the study of the gavel,we can know the reason and social background of choosing to use the gavel, understand the style and rules of the gavel, most important of all we can realize the judicial ideas and culture of law. And then, we can know whether it is useful or not to the confirm of legal consciousness and belief in the rule of law.
