Colleges and universities are the practice base of higher education, and the main place to cultivate senior specialized talents. Stage of higher education is the youth to learn the key stage of growth. Since China’s reform and opening up, along with the development of social economy, our country’s higher education system reform is gradually, and has obtained certain achievement. It completed the popularization of higher education from the elite to the history of the bridge, but also some new exploration. The attention of higher education system reform is rising, of which the first is the reform of the college enrollment system.College enrollment system is an important part of higher education system. It not only guides the basic education, and chooses appropriate talents for colleges and universities. More importantly, it involves each examinee the realization of the right to education and the high hopes of every family. Beginning in 2003, the Chinese Ministry of Education has launched a pilot project of autonomous enrolment in the 22 national universities. This is an important reform of college enrollment system.For more than ten years, the pilot reform of autonomous enrolment of colleges and universities continue to increase. A growing number of colleges and universities have the power of the autonomous enrolment. And at the same time, colleges and universities has been a breakthrough in many ways such as the selection methods and selection standards. However, with the expansion of the power of autonomous enrollment in colleges and universities, it gradually show the advantage, also has exposed many problems, caused a strong reaction from all walks of life. From the perspective of public power, the power of autonomous enrollment of colleges and universities as an extension of the national education management power, must be exercise power within the scope of the laws and regulations, namely "no freedom without law provisions". Because of its "autonomy", the power of autonomous enrollment of colleges and universities has intrinsic expansionary. If it is lack of effective process control, the power is easy to be abused. In view of the reality and existing problems, this paper using the related theory as the analysis tool of law, try to put forward to improve the operating advice about power of autonomous enrollment of colleges and universities.In this paper, the first chapter is introduction part that introduces the cause of the selected topic and the research status about autonomous enrollment of colleges and universities, the public power perspective as a starting point for research. And define some concepts, such as colleges and universities, autonomous enrolment of colleges and universities and special college admissions. The second chapter researches in the theory of power of autonomous enrolment in colleges and universities, through the analysis of its theoretical basis and legal source to reveal the essence of the power of autonomous enrollment in colleges and universities. The third chapter explores the realistic significance of the power of autonomous enrollment in colleges and universities from the historical dimension, longitudinal analysis the rationality of the power of autonomous enrolment of colleges and universities. Chapter IV reveals the power of autonomous enrollment in colleges and universities exist in the actual operation the possibility of being abused, by the case analysis of Fudan University, and the abuse of power has become the bottleneck of restricting its development. Chapter V is the legal regulation of the power of independent recruitment of students in colleges and universities, to solve the problem of abuse of power, using the related theory of law, to regulate the power of autonomous enrolment in colleges and universities respectively from the substantive standard and procedural control and the relief of illegal behavior, in order to make the power of autonomous enrolment in the orbit of the rule of law in good operation.
