| With the prosperity of international shipping industry, international shipping business carrying most of the volume has been increasingly refined and the division of labor is more diverse. NVOCC emerged, generally from the international freight forwarding, inland transport operators or the station man. However, due to the scope of business which is also accompanied by a cross, the legal status is not clear, B/L is not strictly regulated, the related parties recognize the concept of the law clearly and so on. Thus, deliverying of cargo without original B/L and maritime fraud have occurred.Container Transport spawned NVOCC, currently domestic and international law have uniform definition, recognizing their identity both shipper and carrier; Analyze the relationship between NVOCC and the actual carrier, NVOCC and international freight forwarders, NVOCC and international multimodal transport operators. Clear the different levels of performance responsibility NVOCC and the actual carrier to the contract. NVOCC B/L is mainly used for settlement, the actual carrier B/L for delivery; consolidated revenue acquisition mode, contract terms, issued conditions of NVOCC B/L and so on, then identify nvocc and freight forwarders, in order to avoid NVOCC use freight forwarders status to shirk responsibility; simultaneously introduce NVOCC under what conditions transfer into international multimodal transport operator. NVOCC use unregistered B/L to avoid shipments risk. The effectiveness of unregistered B/L, and the validity of the contract were analyzed. NVOCC brings convenience to exporters and the risk of delivery without B/L. NVOCC brings importers the risk of fraud and refuse delivery of goods. At the same time these risks presented have coping strategies. Finally, describe the regulatory status about NVOCC industry and made several recommendations. |
