| The introduction of this thesis is basing on the legal problems about the policy violations in the commodity house purchase and sales contract.Chapter one is mainly talking about the reasons causing the violations which contain the influences to the contract by policy implications and the properties, the policy implications as well as the similarities and differences between policy violations with normally violations. And the differences include three aspects: the implications and extension, the imputation principles and the inscapes then analyzing the situations and liabilities in policy violations. Chapter two primarily introduces today’s classification about the policy violations as well as the force majeure, the changes of situations and the commercial risks and then take the commodity house purchase and sales contract as an example to illustrate. Furthermore, the author will combine three different theories to comment it.Chapter three classifies and sums up the present cases and divides these cases into several groups. And this method is also available in other similar case.in this paper we shall apply different methods in different situations,but of course, we are now still lack of such cases so this part is just serve as a modest spur.And in order to avoid hipping, we should use different means case by case in the future.Chapter four is the conclusion.The purpose and significance of this thesis is define the commodity house purchase and sales contract in today’s justice practice. And give a clear rule on when to apply the force majeure and when to change situation. And this paper chooses the policy violations in the commodity house purchase and sales contract as an example to explain these issues. In this thesis I used componential analysis method and try to classify the policy violations, the force majeure and the changes of situation and then use the result to extend the legal meaning and fill the bugs in the present laws. This paper is also applied the comparative method to compare and classify the concepts of the force majeure, the changes of situation and the commercial risks and then find a better way to solve the present legal issues.Moreover, this paper also adopt vast literature review and under such academia we can have a deeper study on the policy violations in the commodity house purchase and sales contract. |
