The Discourse Analysis Of The Technical Reconnaissance Added To The Criminal Code And Grass-roots Public Securitytechnical Reconnaissance Work

The new Criminal Procedure Law of the People’s Republic of China was enacted on the April 14th, the most important influence for grass-roots public security technical investigation work of which has added a section named measures of technical investigation, which is habit referred the change as crimination for technical investigation. This significant change legalized technical investigation, and provided legal ground for technical measures of investigation utilized in solving public security cases, which revealed the secret roles of those "unknown heroes"-technical investigators. Crimination for technical investigation, is the imperial sword for public security, are better playing technical investigative advantages in practice, and within the legal framework to combat crime more effectively. Comparing and learning foreign legalism practice, and combining our actual condition, we have explored the new change of that crimination for technical investigation would bring to public security cases, In allusion to the practice, the paper puts forward corresponding measures to improve them, including further defined the scope of the technical investigation measures, improve the ability to use the evident of technical investigation, correctly handle the relationship between openness and confidentiality, further defined the provision of verifying the evidence out of the court, the parties adopting the measure of technical investigation need to be given the rights of remedy, etc.
