The Comparative Study Of Chinese And Foreign Administrative Accountability System

Since the eighteenth congress has been held,the new central collective leadership increase the biggest attention about anti-corruption.As a result,many provincial officials lost their job, and people applaud about these achievements.The party and administration system raise a more profound understanding of administrative responsibility,at the same time, the problem of administrative accountability system arouse people’s attention again.Administrative accountability system is shouldering the expectations from the date of issued and implemented,but the effect of the system is not particularly significant.At the beginning of this paper is to define the concept and connotation of the administrative accountability system. The current academic scholars have made many definition of administrative accountability system,but cannot get the unified definition.In account of this,my paper combine all of many point of view and give my own explanation.The administrative accountability system should be different from chief responsibility system,resigned and administrative responsibility, etc, it is refers to the specific subject of accountability supervise and review over all levels of government, various government departments and their administrative personnel, and according to legal procedures, make them bear the negative consequences if they do not perform properly.So make the government as civil servants realize its administrative powers and duties.Then the article analyzes the theoretical basis of administrative accountability system.Tracing the theoretical basis of administrative accountability system, and in this paper lists the five theory of popular sovereignty, social contract theory, entrust generation theory, the theory of responsible government, rule of law government, etc.In the main part of the article, there is the longitudinal comparison about the Chinese and western administration accountability system.In this paper,the logic of comparation study is mainly from the perspective of cultural context of the specific system, so this article will compare the dimensions as the following two, respectively to compare Chinese and western administration accountability system background and Chinese and western content of concrete system.Refering about the specific content of the system in China and the west, this paper is divided into the following five dimensions:the subject of administrative accountability, administrative accountability, administrative accountability of the organization, administrative accountability procedures and the way of responsibility, the relief of administrative accountability.Finally in this paper, through the above multiple perspectives comparison of Chinese and western administrative accountability,and according to the environment and conditions of our country’s reality, then puts forward the localization measures like,complete the subject of the administration accountability, including strengthen consubstantiality accountability and improve allogeneic accountability;complete the operations of our country administration accountability,including administrative accountability program startup, in the process of accountability procedures and accountability relief; complete our country administration accountability mechanism, including perfecting the government information disclosure system, perfect the administrative cultural construction and perfect the system of the rule of law.
