Discussion On The Crime Of Breach Of Contract Behavior

Breach of contract behavior has been mainly regulation by the civil law, but in recent years, with the diversification of the development of criminal behavior, way of crime is innovative and the degree of harm to continuously deepen, the civil law can’t make the social harmfulness get properly controlled, the existing law is already not sufficient to give the appropriate punishment for these behaviors. The criminal law in the process of constantly modified some breach of contract behavior into the scope of regulation.Because of the characteristics of criminal law itself and the properties of the breach of contract behavior, making the breach of contract behavior of the crime this phenomenon has produced many issues worthy of discussion. This paper will study from the legal perspective research the phenomenon of the criminal breach of contract behavior. Through study on the criminal phenomenon of the breach of contract behavior, these phenomena include the crime of refusing to pay the remuneration, the crime of infringement of business secret, the crime of credit card fraud, analysis this problem, this problem caused by the phenomenon, the legislative background of existence, theory evidence etc,thus obtains the legal thinking of value.
