Research On Anti-Monopoly Legal Regulations Of Campus Telecommunication

Nowadays,with the rapid development of telecommunication technology, campus telecom has become a part of college students’ daily life. Campus telecom monopoly occurs frequently, however, more media exposure of cases involving monopoly of campus network and telecom happens, which cause public concern. Campus telecom monopoly not only destroyed the order of fair competition of campus telecom market, also brought a lot of inconvenience to life of the undergraduates, thus seriously infringing legitimate rights and interests of consumers on campus. If we are to put an end to the occurrence of monopoly, it is necessary to analyze the causes objectively, which involves reasons concerning legislation, judicature, law enforcement, even campus telecom operating model. Monopoly discussed in this paper is only behavior conforming to the rules of law and constitutive requirements of monopoly.This paper is divided into three parts. The first part mainly discusses phenomenon of campus telecom market monopoly. First, we need to clarify notions of telecommunications, telecommunication industry, telecommunication on campus, campus telecommunication service and figure out the relations between them. Then we conduct analysis concerning law and facts about campus telecom monopoly, including: the behavior of abusing dominant position in market, suspected behavior of administrative monopoly, joint behavior of limiting competition. Through the analysis of definitions of the three behaviors and specific performance, the second part focuses on causes of existing telecom monopoly, respectively, including: campus telecom related laws and regulations are not complete; existing anti-monopoly law lacks protection of consumer rights and interests; campus telecom antitrust enforcement power attribution is not clear; the campus telecommunications operation mode has problems. The third part is mainly on putting forward my own proposal on developing anti-monopoly law. If we want to solve the problem of campus telecom monopoly, we need to start from the macroscopic, microscopic and operating pattern: on macro level, we should establish the correct supervision idea and principle of regulation; on micro level, we should perfect the application rules of anti-monopoly for campus telecoms, strengthen the protection of campus telecom consumers’ rights and interests, and clear ownership of campus telecom antitrust enforcement right; As for operating mode, the law and policy should guide and encourage its transformation, thus forming a benign mechanism which could reconcile contradiction and scatter administrative power and fundamentally reducing the possibility of monopoly of campus monopoly. Only through these measures, can we ensure the campus telecom market healthy and orderly development.
